PRIVACY POLICY

1. Introduction

1.1 Ford Group Philippines (and its affiliates: Ford Motor Company Philippines, Inc. hereafter referred to as Ford) is committed to its great responsibility to keep your personal data secure which follows the principle of personal right protection and conforms to provisions as contained in the Republic Act No. 10173 (Privacy Act). We give priority to your personal right. We also apply policy and process in relation to personal data management in accordance with the Privacy Act. Our policy concerning data protection covers all operations to any personal data received through method collecting information, aim of data application and entitled persons to the data.

1.2 Authorised Ford Dealers (“Dealers”) are independent entities and not related to Ford and may have privacy policies which differ from ours. Dealers are responsible for their own privacy policies and privacy practices. Please contact your Dealer directly for further information.

1.3 We may change our Privacy Policy from time to time at our discretion. At any time, the latest version of our Privacy Policy is available from our Customer Relationship Centre.

1.4 If you drive a Ford Connected Vehicle, please carefully read the Ford Connected Vehicle Terms and Privacy Policy.

1.5 If you use the Ford App, please carefully read the Ford App Terms and Privacy Policy.

1.6 If you are the owner or driver of a Ford vehicle, it is important to be aware of these privacy safeguards:

  • Inform others who drive the vehicle, and passengers who connect their mobile devices to the vehicle, about the information in this Privacy Policy, including the Connected Vehicle Terms and Privacy Policy; and
  • If you plan to sell or transfer your vehicle, remember to perform a Master/User Reset of your vehicle before it leaves your possession. Please review the Connected Vehicle Privacy Terms for more information.

2. What This Privacy Policy Covers

This Privacy Policy explains our collection, use, and disclosure of personal data, including information we collect through our Products, at offline locations and events, and from third parties. It also includes information about your privacy rights and how to exercise them.

This Privacy Policy covers and applies to:

Products, services, and features we provide, such as websites, mobile applications, online services, technology platforms, and devices we own or operate, as well as the vehicles we manufacture (collectively, “Products”).

Personal data collected by or on behalf of Ford Group Philippines, Inc. and our affiliates and subsidiaries (collectively, “Ford,” “we”, “us” or “our”) through Products that link to, refer to, or display this Privacy Policy (for example, on their websites or in their own privacy notices).

The following Connected Services (defined in the Connected Vehicle Terms and Privacy Policy), which have a Product-specific privacy notice that supplements this Privacy Policy (for mobile applications, you should also review the privacy information contained on the Ford App applications’ download pages, which supplement this Privacy Policy).

3. What is personal data?

In this Privacy Policy, “personal data” has the meaning set out in the Privacy Act. Essentially, personal data is any information whether recorded in a material form or not, from which the identity of an individual is apparent or can be reasonably and directly ascertained by the entity holding the information, or when put together with other information would directly and certainly identify an individual.

4. What types of personal data does Ford collect?

4.1 The types of personal data Ford collects from you depend on the circumstances in which the information is collected. Information you provided to us includes:

  • Depending on the nature of your interaction with us, we collect personal or business information such as name, email address, postal address, and phone number. We may also ask you to provide email addresses of others, for example if you use a “tell-a-friend” tool.
  • When you interact with us or our Products, you may also provide additional information such as your age range, nationality, date of birth, occupation and gender.
  • If you make an online reservation for Products, we collect credit card numbers and other payment or billing information.
  • You may indicate preferences such as your preferred communication method, language, time zone, and dealer. When you use the vehicle shopping tools on our website, you indicate through your browsing and searches the kinds of vehicles, features, and options you may be interested in.
  • In some cases, you can upload a photo for a profile image when creating an account, or you may provide your photo at an event or as part of a contest or sweepstakes.
  • Depending on the nature of your interaction with us, you may provide us with unique identifiers associated with you including your driver’s license and registration details and information about your vehicle (including its number plate and vehicle identification number). For example, when you leave a comment on one of our social media sites, you provide us with your social media ID.
  • When you create or modify your Ford account, you provide us with an email/username and password, along with other information used to authenticate your account such as answers to security questions, etc. You can use these credentials to sign into other Ford experiences (if supported), so you only need to remember one username and password when accessing our online and mobile Products.
  • When you communicate with us, such as via emails, customer service requests, survey responses, website chats or social media posts, likes, or messages, we collect the content of your communication.
  • We collect vehicle service history from you when you provide it to us on our sites.

4.2 Information From Your Vehicle

Ford vehicles have systems that record data about how the vehicle is performing, how it is driven, where it is located, and the environment where it is operated. This data may be associated with a vehicle's unique identification number (“VIN”) or other identifiers, and VIN or the other identifiers may be linked to you.

If your vehicle is equipped with Connected Services or has factory-installed connectivity technology capable of electronically transmitting vehicle-originated data to Ford, we may collect the following categories of information from your vehicle:

  • Vehicle Data
  • Driving Data
  • Vehicle Location (which may be collected through location-based features and functions in the vehicle or in our mobile apps and which may be derived from other information such as your mobile device’s location)
  • Audio/Visual
  • Media Analytics
  • Vehicle Analytics

Which categories of information are collected from your vehicle typically depends on how the vehicle is equipped for connectivity; in other words, what connectivity technologies, software version, data sharing settings, and Connected Services are present and what selections have been made for the data sharing settings. See the Connected Vehicle Terms and Privacy Policy for details and data category definitions.

In limited situations, we may collect Vehicle Location, regardless of location settings. We do this to protect and defend our rights or property (including repossessing a vehicle in the event of a delinquency) or to comply with applicable law, to respond to valid legal process (including from law enforcement or other government agencies), or, in the event of exigent circumstances, to help prevent the loss of life or serious injury or help protect the personal safety of Ford personnel, users of our vehicles, websites, or apps, our visitors, or the public.

4.3 Information From Your Devices

When you use our websites, mobile apps, online services, and other Products, we automatically collect some information from the devices you’re using (such as mobile phone, tablet, smartwatch, or computer). For example:

Device Details and Network Information: Some devices reveal, and our servers log, information such as type of device, hardware model, MAC Address, operating system, version, settings, configuration, and network-related information (for example, IP address, mobile network provider, etc.). We may also collect device motion information if you enable that functionality in our mobile apps. As described more in the ookies section below, our websites and online Products store and retrieve device identifiers (such as browser and other unique online identifiers) using cookies, pixel tags, and other digital technologies set on your device.

Digital Activity: As described more in the Cookies section below, when you browse our website or use our other online Products, we collect information about your online activity and interaction with our Products, such as access times, webpages or content viewed, mouse movements, scrolling, features used, how the webpage or online feature performed, the results of vehicles saved, built, searched for, or viewed during previous visits, other websites visited, etc.

Device and Mobile Location: Depending on your device and app settings, we also collect location data from your devices. If your mobile device is connected to your vehicle via Bluetooth or tether, vehicle location may be derived from mobile device location.

You may use app or device controls to prevent certain types of automatic data collection. But if you choose not to provide or allow information that is necessary for certain Products or features, those Products or features may not function correctly or be available for use.

4.4 Information We Generate About You

We generate information from the data we collect. For example:

Digital Activity: When you build or search for vehicles on our website, we generate results that fit your criteria and allow you to save results so that they are available to you in future visits. When you browse our website or use our other online Products, we may infer your zip code, city, state, and/or country location based on your IP address.

Inferred Preferences: We infer new information from other data we collect, including using automated means to generate information about your likely preferences or other characteristics. For example, we may use information about your vehicle and past purchases to determine your likely readiness to make a new purchase, which we may use for marketing, advertising, or other purposes. We may also infer information from your online activity and interaction with our Products, such as webpages visited, vehicles viewed, app features used, etc.

Identifiers: When you interact with us, we may generate unique identifiers associated with you or your devices such as Ford account ID, customer ID, rewards program number, or browser or other online identifiers. These unique identifiers help us identify you or associate you with information about you. For example, in our exhibits at auto shows or other events, we may generate a bar code for each visitor that you can swipe as you interact with the exhibit. It may also allow you to access and spread photos and videos if you use available technology to take your picture and/or video at the event.

Payment Data: We may generate information when you pay for products reservation and services, e.g., transaction history.

4.5 Information From Other Sources

We obtain information from others when you direct them to disclose information to us.

We also obtain information from the following sources:

  • Affiliates: We receive information from other companies within the Ford Motor Company family of companies and affiliates. Our “family of companies” is the group of companies related to us by common control or ownership. Information is disclosed within this “family” as a normal part of business operations, offering products and services to our customers, and allowing our customers to use their Ford account across multiple Ford experiences (if supported).
  • Dealers and Other Repairers: We receive information in connection with vehicle sales and service. For example, when you purchase a vehicle from a Ford or Lincoln dealer, the dealer provides Contact Information to Ford, including your name and address, as well as VIN and purchase information such as purchase date. When you service or repair your vehicle with a Ford dealer, we receive Contact Information and Vehicle Service History information (and certain other vehicle repair information), which includes history of repairs and may include information such as visit details, service details, repair history, applicable recall repairs, repair order details and payment, and warranty and extended service plan information. We may receive vehicle diagnostic information from dealers or other repairers when your vehicle is serviced or repaired using diagnostic scan tools connected to your vehicle.
  • Vendors and Suppliers: We may receive Contact Information or other personal data from our vendors or agents working on our behalf for the purposes described in this Privacy Policy.
  • Business Partners: We receive personal data from other companies we work with to offer services to our customers, or to reach potential customers with our marketing messages. Examples include:
  • Advertising and Analytics Companies: Please see the Cookies section of this this Privacy Policy for a description of how we receive information from advertising and analytics providers.
  • Joint Marketing Partners: We may receive personal data from partners with which we offer co-branded services or engage in joint marketing activities.
  • Law enforcement agencies, courts, regulatory agencies, and others: We may receive personal data from government agencies or courts for legal compliance purposes, to protect your personal safety or the safety of others, to protect Ford’s or others’ rights or property, or to investigate fraud. We may also receive personal data from others; for example, in connection with litigation settlements, we may acquire information about you from third parties for the purpose of meeting our tax reporting obligations.
  • Consumer Data Analytics Firms: We receive Contact Information, Demographics, and other data from third parties for purposes such as keeping information current, supporting our marketing campaigns, and personalizing Products to our customers.
  • Parties to Corporate Transactions: We may receive personal data as part of a corporate transaction or proceeding such as a merger, financing, acquisition, bankruptcy, dissolution, or at transfer, divestiture, or sale of all or a portion of business or assets.
  • Publicly Available Sources: We may obtain Demographics and other data from publicly available sources, such as open government databases or other data in the public domain, as well as information that is publicly available online on social media, networking, and other sites.

4.6 If you are an employee,individual contractor to Ford, in addition to the information referred to in section 3.1 we may collect information relevant to your engagement with Ford including qualifications, length of engagement, resume, pay rate and salary, bank details, feedback from supervisors, training records and logs of your usage of Ford equipment (e.g. phones, computers and vehicles). A reference to an individual contractor in this document includes those individuals who perform work for Ford under a “purchased service” arrangement. If you are employed by or contracted to a Dealer, we may also collect and maintain training records about you.

4.7 Ford does not generally require customers to disclose any sensitive information (e.g. details of race, religious beliefs, sexual orientation, health information etc.) to us. In limited circumstances, we may require employees, prospective employees, individual contractors and Dealer personnel to provide us with certain health information.

4.8 Occasionally, sensitive information in relation to an individual’s membership of a trade or similar association may be provided to us but we do not actively seek this information. We will only use and disclose that information for the purpose for which you disclosed it to us and as permitted by the Privacy Act and other relevant laws.

5. How do we collect your personal data?

5.1 Ford collects personal information in a number of ways. The most common ways we collect your personal data are:

  • directly from you when you provide it to us or our employees, agents or contractors (e.g. via our Customer Relationship Centre);
  • via Dealers and other repairers, including Vehicle Identification Number (VIN), purchase date, vehicle service and repair history (such as repair orders, recall repairs, and payment information), and vehicle diagnostic information captured via scan tools during service;
  • via our website or when you deal with us online (including through social media, eCommerce, Online Service Booking platform, Pick Up and Delivery, and any platform/channel on Ford website);
  • via our market research agencies;
  • via advertising and analytics companies and joint marketing partners;
  • via consumer data analytics firms to keep our records current and personalize our services;
  • when you enter a competition or promotion;
  • if you are our employee during normal course of employment;
  • if you are an individual contractor to Ford, from your employer or recruitment agency;
  • if you are employed by or contracted to a Dealer, from that Dealer;
  • via in-vehicle technologies (e.g. SYNC system analytics and diagnostics features);
  • via the SYNC owner forum or the owner portal;
  • from law enforcement, courts, or regulatory agencies for legal compliance and fraud investigation;
  • from parties involved in a corporate transaction such as a merger or sale of assets;
  • from publicly available sources including government databases and social media;
  • from our related companies; and
  • from third parties (for example, from referees if you apply for a position as an employee or contractor with us).

6. For what purposes do we collect, use and disclose your personal information?

6.1 The purposes for which we use and disclose your personal information will depend on the circumstances in which we collect it. Whenever practical we endeavor to inform you why we are collecting your personal information, how we intend to use that information and to whom we intend to disclose it at the time we collect your personal information.

6.2 We may use or disclose your personal data:

  • for the purposes for which we collected it (and related purposes which would be reasonably expected by you);
  • for other purposes to which you have consented; and
  • as otherwise authorized or required by the Privacy Act.

6.3 In general we collect, use and disclose your personal data so that we can do business together and for purposes connected with our business operations.

6.4 Some of the specific purposes for which we collect, use and disclose personal data are as follows:

  • to facilitate your request for a brochure or test drive, to add you to a mailing list or to respond if you request information (including via the Ford website or via an email you send to us);
  • to record and maintain the details of your purchase of a Ford vehicle for warranty purposes or your purchase of a Ford product or service for administration purposes;
  • to keep track of the repairs and servicing of your Ford vehicle by Dealers;
  • contact you about the services we provide thru eCommerce, Online Service Booking platform, Pick Up and Delivery, and any platform/channel on Ford website;
  • to facilitate the provision of roadside assistance and other services you acquire from us, Dealers or our agents or contractors;
  • to inform you in the event of a field service action, for example a recall, affecting your Ford vehicle;
  • to issue service reminders;
  • to improve our products and services;
  • to help us identify and diagnose SYNC system usage and performance issues for quality assurance purposes and to improve our products and services;
  • to contact you (directly or through our service providers and marketing research agencies) to obtain your feedback and to find out your level of satisfaction with our products, services and Dealers through surveys;
  • to report to and evaluate Dealers;
  • to verify your identity;
  • to facilitate your entry and participation in a competition or trade promotion;
  • to consider you for a job at Ford (whether as an employee or contractor) or other relationships with us;
  • to provide goods or services to you or to receive goods or services from you;
  • to address any issues or complaints that we or you have regarding our relationship;
  • conduct research and develop new and improved products, services, and business and marketing strategies;
  • to conduct troubleshooting and debugging activities to identify and repair technical errors that impair existing or intended functionality of vehicle or digital systems;
  • to prevent, detect, and investigate security incidents, identity theft, fraud, harassment, or other malicious, deceptive, or illegal activity;
  • to help prevent the loss of life or serious injury or to protect the personal safety of individuals in exigent circumstances;
  • to manage business functions including accounting, finance, tax, and regulatory compliance, and to evaluate the quality of products and services provided by our suppliers;
  • comply with legal requirements or requests from public authorities; and
  • to contact you regarding the above, including via electronic messaging such as SMS and email, by mail, by phone or in any other lawful manner.

6.5 We may also use and disclose your personal data for the purpose of direct marketing to you where you have consented Ford to deliver any direct marketing to you, or it is otherwise permitted by Privacy Act. Direct marketing involves communicating directly with you for the purpose of promoting goods or services to you. Direct marketing can be delivered by a range of methods including mail, telephone, email, SMS or in-app notifications. You can unsubscribe marketing communication from Ford at any time by contacting us as detailed below. If you wish to unsubscribe from direct marketing you have received from a Dealer, please contact that Dealer directly.

6.6 We may also collect your personal data from any transaction which you directly do with us through our contact centre, Customer Relationship Centre, website or magazine on internet. However, if we want to collect information from aforesaid channel, we will always inform you that whom the information will be used or disclosed to, how it will be used, and what it will be used with.

6.7 In addition, when we process data we collect for the purposes described in this Privacy Policy, we may use artificial intelligence (“AI”), machine learning, and other automated decision-making technologies to support the processing, in accordance with applicable law. To support our Products, we may use AI-enabled chatbots, some of which may be provided by vendors. If a Product involves an AI-enabled chatbot, we will inform you of that at or before the initiation of the chat. Information about how to contact a live person or our Customer Relationship Center will be available, either in the chat functionality or in this Privacy Policy. Any information shared via an AI-enabled chatbot may be processed, stored, or used in accordance with this Privacy Policy and any applicable Product terms and conditions.

6.8 In carrying out these purposes, we may combine data we collect from different sources to give you a more seamless and personalized experience. For example, we may use your Ford account identifier or unique online identifiers to link your digital activity over time and across different Ford products or digital properties, including those owned or operated by third parties.

6.9 We may de-identify information we collect about you (including vehicle data) so that it can no longer be reasonably linked to you. We may use and disclose such de-identified information for any purpose in accordance with applicable laws.

7. What will happen if you fail to give Ford your personal data?

Generally, you are not bound to give us your personal data. However, if you prefer not to give us your personal data, we may not be able to notify you of information relating to products and services. For example, you fail to specify category and model of products purchased, we cannot inform you of information of new products which will be useful to the one.

8. Security Measures

We have reasonable security measures regarding personal data, including organizational, technical, and physical safeguards in relation to access control, to protect the confidentiality, integrity, and availability of personal data against any unauthorized or unlawful loss, access, alteration, correction or disclosure of personal data, in compliance with applicable laws.

Ford has implemented access control measures and the use of data storage and processing devices which are secured and suitable for the collection, use, and/or disclosure of personal data. We restrict access to personal data as well as storage and processing devices by imposing access rights or permission, allowing only authorized individuals to access personal data, and implement user responsibilities to prevent unauthorized access, disclosure, perception, unlawful duplication of personal data or theft of storage or processing devices. We also have appropriate measures to enable the re-examination of access, alteration, deletion, or transfer of personal data.

9. To whom will we disclose your personal data?

9.1 We may disclose your personal data to third parties in connection with the purposes described in section 6 of this Privacy Policy.

9.2 This may include disclosing your personal data to the following types of third parties:

  • Dealers to assist in diagnosing service needs before you arrive, to allow for the redemption of loyalty program rewards, and to support joint marketing activities;
  • Our affiliates and related companies including for the purpose of providing a single sign-on experience across Ford mobile and online products, and to assist related financial entities (e.g., Ford Credit) in vehicle location or account management where permitted by your agreements;
  • Vehicle verification and valuation partners, such as auction companies, insurance companies, lenders, and prospective buyers, to verify a vehicle’s factory-installed features and estimate its value based on the VIN;
  • Third-party partners who provide in-vehicle entertainment or trial services (such as satellite radio or connectivity providers) and other co-branded service partners;
  • other persons who perform services for, or in connection with, us (including mailing vendors, marketing agencies, roadside assistance providers, analytics providers, event hosting services, website and data hosting providers and other information technology providers, for trend analysis, for market analysis or research, for sale promotions activity and for the provision of statistical sales information to industry bodies);
  • companies who may use your personal data in order to tailor electronic advertising to you (e.g. on a webpage) in relation to our products and services;
  • our accountants, insurers (including those that provide extended warranties), lawyers, auditors and other professional advisers;
  • if you are an individual contractor to Ford, to your employer or agency in relation to the performance of your work with Ford;
  • if you are an individual contractor to Ford or a prospective employee, to our medical service providers for any medical assessments or in relation to any health or safety incidents and to HR related service providers (e.g. for background checks, screening or aptitude testing);
  • any third parties to whom you have directed or permitted us to disclose your personal data (e.g. referees);
  • third parties that require the information for law enforcement or to prevent a serious threat to public safety, to detect, investigate, or remediate cyberattacks on our networks; to protect the rights and property of Ford and its affiliates; and in exigent circumstances, to help prevent loss of life or serious injury; and
  • otherwise as permitted or required by law.

9.3 Where we disclose your personal data to third parties we will use reasonable commercial efforts to ensure that such third parties only use your personal data as reasonably required for the purpose we disclosed it to them and in a manner consistent with the Privacy Act, e.g. by including suitable privacy and confidentiality clauses in our agreement with a third party service provider to which we disclose your personal data.

9.4 If you post information to certain public parts of our website or to our social media pages, you acknowledge that such information may be available to be viewed by the public. You should use discretion in deciding what information you upload to such sites.

9.5 Ford does not share, sell, or rent personal data with independent companies for their own use without providing you a choice. If you have opted in to receive marketing materials from Ford, we may share hashed emails from our marketing database with social media advertising partners, such as Facebook, so that they can create Custom Audiences and deliver advertisements on our behalf to their members. Members are identifiable when the Social Media partner matches our hashed data to its hashed data of its members.

9.6 We may disclose your personal data as part of a corporate transaction or proceeding such as a merger, financing, acquisition, bankruptcy, dissolution, or at transfer, divestiture, or sale of all or a portion of our business or assets. Furthermore, we may disclose de-identified information (which can no longer reasonably be linked to you) to third parties for any purpose in accordance with applicable law.

10. OTHER SITES AND SERVICES

Our websites, mobile applications, and other Products may contain links to other content, products, services, features, websites, mobile applications, platforms, or properties that Ford doesn’t own or operate (“Other Sites”) even if they look similar to ours. Please be aware that Ford is not responsible for any Other Sites, their content or operation, or the privacy policies or data practices of the third parties that offer them, even if you access them via our Products, including:

  • Dealer websites;
  • Websites or services featuring events, promotions, sponsorships, contests, or sweepstakes offered by our business partners (even where co-branded with Ford or our Products);
  • Websites or services offered by companies that have received a license to use our name, logo, or other trademarks in connection with their service or product offerings (including those that offer accessories or other products available for use with Ford vehicles);
  • Advertisers on our websites;
  • Social media or networking platforms; and
  • Product review, news, or enthusiast/fan sites and other forums, message boards, or chat groups where our Products are discussed.

For example, some of our website features incorporate the Google reCAPTCHA tool, which collects hardware and software information, such as device and application data, in order to perform integrity checks and help prevent bots from using the feature. Your use of the reCAPTCHA tool is subject to the Google Privacy Policy and Terms of Use.

Ford is also not responsible for third party applications or services that are governed by a privacy policy other than Ford’s and that may

  • Be integrated with or offered through our Products;
  • Be made available to you through the vehicle infotainment system or in our mobile apps;
  • Be made available to you through the third party's app on your mobile device when you connect your mobile device to the vehicle via Bluetooth or tether; or
  • Require or permit the account you have with the third party to be linked to a Ford or Lincoln vehicle, mobile application, or other Product.

For example, some of our websites and online Products include mapping features provided by Google, HERE, and Microsoft (Bing Maps), which will collect and use personal information, including location information. If you use those mapping services, provide personal information to any of those third parties, or consent to our disclosure of personal information to them, the personal information they receive is governed by their privacy statements available via the above links. For example, if you use Bing Maps you agree to be bound by the Bing Terms of Use and Microsoft Privacy Policy.

11. Does your personal data leave the Philippines?

The parties to whom we disclose and/or transfer your personal data include parties located outside the Philippines. For example, we transfer personal data to our related companies overseas and to our overseas service providers. 12. How do we treat your personal data?

Ford takes security seriously and precaution to keep your personal data secure from any use, disclosure and any alteration without given permission. We train our employees to be aware of their roles and duty affecting personal data management. The authorized employee is entitled to learn the personal data and use it to the extent of his responsibility. Your personal data will not be distributed to any irrelevant organizations and we will not share your personal data other than related services provider companies (as specified above) only.

13. How do we treat information disclosed by your job application?

13.1 If you submit a job application to Ford, we will use the information provided by you to assess your application. Ford may disclose the information contained in your application to contracted service providers for purposes such as screening, aptitude testing, medical testing and human resources management activities.

13.2 As part of the application process or (if you are successful in being employed by Ford) after you commence employment with Ford, you may be required to complete a health questionnaire. You may also be asked to undergo a medical assessment. In that case, you will be asked to give specific consent for Ford to disclose your questionnaire to its service providers for the purposes of the medical assessment and for the relevant service providers to disclose the results of the assessment to Ford.

13.3 If you refuse to provide any of the information requested by Ford, or to consent to Ford disclosing your questionnaire to its service providers for the purpose of a medical assessment or to the disclosure of the results of your medical assessment to Ford, we may be unable to consider your application (or if you have been successful in being employed by Ford, we may not be able to consider you for particular roles or positions within Ford).

13.4 Ford may also ask you whether you agree to your personal data being provided to appropriate Ford suppliers so that you may be considered for positions with those suppliers which are relevant to your qualifications and experience.

We retain personal data for as long as necessary to provide the products and fulfill the transactions you have requested, comply with our legal obligations, resolve disputes, enforce our agreements, and other legitimate and lawful business purposes. 3. What is personal data?

In this Privacy Policy, “personal data” has the meaning set out in the Privacy Act. Essentially, personal data is any information whether recorded in a material form or not, from which the identity of an individual is apparent or can be reasonably and directly ascertained by the entity holding the information, or when put together with other information would directly and certainly identify an individual.

4. What types of personal data does Ford collect?

4.1 The types of personal data Ford collects from you depend on the circumstances in which the information is collected. Information you provided to us includes:

  • Depending on the nature of your interaction with us, we collect personal or business information such as name, email address, postal address, and phone number. We may also ask you to provide email addresses of others, for example if you use a “tell-a-friend” tool.
  • When you interact with us or our Products, you may also provide additional information such as your age range, nationality, date of birth, occupation and gender.
  • If you make an online reservation for Products, we collect credit card numbers and other payment or billing information.
  • You may indicate preferences such as your preferred communication method, language, time zone, and dealer. When you use the vehicle shopping tools on our website, you indicate through your browsing and searches the kinds of vehicles, features, and options you may be interested in.
  • In some cases, you can upload a photo for a profile image when creating an account, or you may provide your photo at an event or as part of a contest or sweepstakes.
  • Depending on the nature of your interaction with us, you may provide us with unique identifiers associated with you including your driver’s license and registration details and information about your vehicle (including its number plate and vehicle identification number). For example, when you leave a comment on one of our social media sites, you provide us with your social media ID.
  • When you create or modify your Ford account, you provide us with an email/username and password, along with other information used to authenticate your account such as answers to security questions, etc. You can use these credentials to sign into other Ford experiences (if supported), so you only need to remember one username and password when accessing our online and mobile Products.
  • When you communicate with us, such as via emails, customer service requests, survey responses, website chats or social media posts, likes, or messages, we collect the content of your communication.
  • We collect vehicle service history from you when you provide it to us on our sites.

4.2 Information From Your Vehicle

Ford vehicles have systems that record data about how the vehicle is performing, how it is driven, where it is located, and the environment where it is operated. This data may be associated with a vehicle's unique identification number (“VIN”) or other identifiers, and VIN or the other identifiers may be linked to you.

If your vehicle is equipped with Connected Services or has factory-installed connectivity technology capable of electronically transmitting vehicle-originated data to Ford, we may collect the following categories of information from your vehicle:

  • Vehicle Data
  • Driving Data
  • Vehicle Location (which may be collected through location-based features and functions in the vehicle or in our mobile apps and which may be derived from other information such as your mobile device’s location)
  • Audio/Visual
  • Media Analytics
  • Vehicle Analytics

Which categories of information are collected from your vehicle typically depends on how the vehicle is equipped for connectivity; in other words, what connectivity technologies, software version, data sharing settings, and Connected Services are present and what selections have been made for the data sharing settings. See the Connected Vehicle Terms and Privacy Policy for details and data category definitions.

In limited situations, we may collect Vehicle Location, regardless of location settings. We do this to protect and defend our rights or property (including repossessing a vehicle in the event of a delinquency) or to comply with applicable law, to respond to valid legal process (including from law enforcement or other government agencies), or, in the event of exigent circumstances, to help prevent the loss of life or serious injury or help protect the personal safety of Ford personnel, users of our vehicles, websites, or apps, our visitors, or the public.

4.3 Information From Your Devices

When you use our websites, mobile apps, online services, and other Products, we automatically collect some information from the devices you’re using (such as mobile phone, tablet, smartwatch, or computer). For example:

Device Details and Network Information: Some devices reveal, and our servers log, information such as type of device, hardware model, MAC Address, operating system, version, settings, configuration, and network-related information (for example, IP address, mobile network provider, etc.). We may also collect device motion information if you enable that functionality in our mobile apps. As described more in the ookies section below, our websites and online Products store and retrieve device identifiers (such as browser and other unique online identifiers) using cookies, pixel tags, and other digital technologies set on your device.

Digital Activity: As described more in the Cookies section below, when you browse our website or use our other online Products, we collect information about your online activity and interaction with our Products, such as access times, webpages or content viewed, mouse movements, scrolling, features used, how the webpage or online feature performed, the results of vehicles saved, built, searched for, or viewed during previous visits, other websites visited, etc.

Device and Mobile Location: Depending on your device and app settings, we also collect location data from your devices. If your mobile device is connected to your vehicle via Bluetooth or tether, vehicle location may be derived from mobile device location.

You may use app or device controls to prevent certain types of automatic data collection. But if you choose not to provide or allow information that is necessary for certain Products or features, those Products or features may not function correctly or be available for use.

4.4 Information We Generate About You

We generate information from the data we collect. For example:

Digital Activity: When you build or search for vehicles on our website, we generate results that fit your criteria and allow you to save results so that they are available to you in future visits. When you browse our website or use our other online Products, we may infer your zip code, city, state, and/or country location based on your IP address.

Inferred Preferences: We infer new information from other data we collect, including using automated means to generate information about your likely preferences or other characteristics. For example, we may use information about your vehicle and past purchases to determine your likely readiness to make a new purchase, which we may use for marketing, advertising, or other purposes. We may also infer information from your online activity and interaction with our Products, such as webpages visited, vehicles viewed, app features used, etc.

Identifiers: When you interact with us, we may generate unique identifiers associated with you or your devices such as Ford account ID, customer ID, rewards program number, or browser or other online identifiers. These unique identifiers help us identify you or associate you with information about you. For example, in our exhibits at auto shows or other events, we may generate a bar code for each visitor that you can swipe as you interact with the exhibit. It may also allow you to access and spread photos and videos if you use available technology to take your picture and/or video at the event.

Payment Data: We may generate information when you pay for products reservation and services, e.g., transaction history.

4.5 Information From Other Sources

We obtain information from others when you direct them to disclose information to us.

We also obtain information from the following sources:

  • Affiliates: We receive information from other companies within the Ford Motor Company family of companies and affiliates. Our “family of companies” is the group of companies related to us by common control or ownership. Information is disclosed within this “family” as a normal part of business operations, offering products and services to our customers, and allowing our customers to use their Ford account across multiple Ford experiences (if supported).
  • Dealers and Other Repairers: We receive information in connection with vehicle sales and service. For example, when you purchase a vehicle from a Ford or Lincoln dealer, the dealer provides Contact Information to Ford, including your name and address, as well as VIN and purchase information such as purchase date. When you service or repair your vehicle with a Ford dealer, we receive Contact Information and Vehicle Service History information (and certain other vehicle repair information), which includes history of repairs and may include information such as visit details, service details, repair history, applicable recall repairs, repair order details and payment, and warranty and extended service plan information. We may receive vehicle diagnostic information from dealers or other repairers when your vehicle is serviced or repaired using diagnostic scan tools connected to your vehicle.
  • Vendors and Suppliers: We may receive Contact Information or other personal data from our vendors or agents working on our behalf for the purposes described in this Privacy Policy.
  • Business Partners: We receive personal data from other companies we work with to offer services to our customers, or to reach potential customers with our marketing messages. Examples include:
  • Advertising and Analytics Companies: Please see the Cookies section of this this Privacy Policy for a description of how we receive information from advertising and analytics providers.
  • Joint Marketing Partners: We may receive personal data from partners with which we offer co-branded services or engage in joint marketing activities.

4.6 If you are an employee,individual contractor to Ford, in addition to the information referred to in section 3.1 we may collect information relevant to your engagement with Ford including qualifications, length of engagement, resume, pay rate and salary, bank details, feedback from supervisors, training records and logs of your usage of Ford equipment (e.g. phones, computers and vehicles). A reference to an individual contractor in this document includes those individuals who perform work for Ford under a “purchased service” arrangement. If you are employed by or contracted to a Dealer, we may also collect and maintain training records about you.

4.7 Ford does not generally require customers to disclose any sensitive information (e.g. details of race, religious beliefs, sexual orientation, health information etc.) to us. In limited circumstances, we may require employees, prospective employees, individual contractors and Dealer personnel to provide us with certain health information.

4.8 Occasionally, sensitive information in relation to an individual’s membership of a trade or similar association may be provided to us but we do not actively seek this information. We will only use and disclose that information for the purpose for which you disclosed it to us and as permitted by the Privacy Act and other relevant laws.

5. How do we collect your personal data?

5.1 Ford collects personal information in a number of ways. The most common ways we collect your personal data are:

  • directly from you when you provide it to us or our employees, agents or contractors (e.g. via our Customer Relationship Centre);
  • via Dealers and other repairers, including Vehicle Identification Number (VIN), purchase date, vehicle service and repair history (such as repair orders, recall repairs, and payment information), and vehicle diagnostic information captured via scan tools during service;
  • via our website or when you deal with us online (including through social media, eCommerce, Online Service Booking platform, Pick Up and Delivery, and any platform/channel on Ford website);
  • via our market research agencies;
  • via advertising and analytics companies and joint marketing partners;
  • via consumer data analytics firms to keep our records current and personalize our services;
  • when you enter a competition or promotion;
  • if you are our employee during normal course of employment;
  • if you are an individual contractor to Ford, from your employer or recruitment agency;
  • if you are employed by or contracted to a Dealer, from that Dealer;
  • via in-vehicle technologies (e.g. SYNC system analytics and diagnostics features);
  • via the SYNC owner forum or the owner portal;

6. For what purposes do we collect, use and disclose your personal information?

6.1 The purposes for which we use and disclose your personal information will depend on the circumstances in which we collect it. Whenever practical we endeavor to inform you why we are collecting your personal information, how we intend to use that information and to whom we intend to disclose it at the time we collect your personal information.

6.2 We may use or disclose your personal data:

  • for the purposes for which we collected it (and related purposes which would be reasonably expected by you);
  • for other purposes to which you have consented; and
  • as otherwise authorized or required by the Privacy Act.

6.3 In general we collect, use and disclose your personal data so that we can do business together and for purposes connected with our business operations.

6.4 Some of the specific purposes for which we collect, use and disclose personal data are as follows:

  • to facilitate your request for a brochure or test drive, to add you to a mailing list or to respond if you request information (including via the Ford website or via an email you send to us);
  • to record and maintain the details of your purchase of a Ford vehicle for warranty purposes or your purchase of a Ford product or service for administration purposes;
  • to keep track of the repairs and servicing of your Ford vehicle by Dealers;

6.5 We may also use and disclose your personal data for the purpose of direct marketing to you where you have consented Ford to deliver any direct marketing to you, or it is otherwise permitted by Privacy Act. Direct marketing involves communicating directly with you for the purpose of promoting goods or services to you. Direct marketing can be delivered by a range of methods including mail, telephone, email, SMS or in-app notifications. You can unsubscribe marketing communication from Ford at any time by contacting us as detailed below. If you wish to unsubscribe from direct marketing you have received from a Dealer, please contact that Dealer directly.

6.6 We may also collect your personal data from any transaction which you directly do with us through our contact centre, Customer Relationship Centre, website or magazine on internet. However, if we want to collect information from aforesaid channel, we will always inform you that whom the information will be used or disclosed to, how it will be used, and what it will be used with.

6.7 In addition, when we process data we collect for the purposes described in this Privacy Policy, we may use artificial intelligence (“AI”), machine learning, and other automated decision-making technologies to support the processing, in accordance with applicable law. To support our Products, we may use AI-enabled chatbots, some of which may be provided by vendors. If a Product involves an AI-enabled chatbot, we will inform you of that at or before the initiation of the chat. Information about how to contact a live person or our Customer Relationship Center will be available, either in the chat functionality or in this Privacy Policy. Any information shared via an AI-enabled chatbot may be processed, stored, or used in accordance with this Privacy Policy and any applicable Product terms and conditions.

6.8 In carrying out these purposes, we may combine data we collect from different sources to give you a more seamless and personalized experience. For example, we may use your Ford account identifier or unique online identifiers to link your digital activity over time and across different Ford products or digital properties, including those owned or operated by third parties.

6.9 We may de-identify information we collect about you (including vehicle data) so that it can no longer be reasonably linked to you. We may use and disclose such de-identified information for any purpose in accordance with applicable laws.

7. What will happen if you fail to give Ford your personal data?

Generally, you are not bound to give us your personal data. However, if you prefer not to give us your personal data, we may not be able to notify you of information relating to products and services. For example, you fail to specify category and model of products purchased, we cannot inform you of information of new products which will be useful to the one.

8. Security Measures

We have reasonable security measures regarding personal data, including organizational, technical, and physical safeguards in relation to access control, to protect the confidentiality, integrity, and availability of personal data against any unauthorized or unlawful loss, access, alteration, correction or disclosure of personal data, in compliance with applicable laws.

Ford has implemented access control measures and the use of data storage and processing devices which are secured and suitable for the collection, use, and/or disclosure of personal data. We restrict access to personal data as well as storage and processing devices by imposing access rights or permission, allowing only authorized individuals to access personal data, and implement user responsibilities to prevent unauthorized access, disclosure, perception, unlawful duplication of personal data or theft of storage or processing devices. We also have appropriate measures to enable the re-examination of access, alteration, deletion, or transfer of personal data.

9. To whom will we disclose your personal data?

9.1 We may disclose your personal data to third parties in connection with the purposes described in section 6 of this Privacy Policy.

9.2 This may include disclosing your personal data to the following types of third parties:

  • Dealers to assist in diagnosing service needs before you arrive, to allow for the redemption of loyalty program rewards, and to support joint marketing activities;
  • Our affiliates and related companies including for the purpose of providing a single sign-on experience across Ford mobile and online products, and to assist related financial entities (e.g., Ford Credit) in vehicle location or account management where permitted by your agreements;
  • Vehicle verification and valuation partners, such as auction companies, insurance companies, lenders, and prospective buyers, to verify a vehicle’s factory-installed features and estimate its value based on the VIN;
  • Third-party partners who provide in-vehicle entertainment or trial services (such as satellite radio or connectivity providers) and other co-branded service partners;
  • other persons who perform services for, or in connection with, us (including mailing vendors, marketing agencies, roadside assistance providers, analytics providers, event hosting services, website and data hosting providers and other information technology providers, for trend analysis, for market analysis or research, for sale promotions activity and for the provision of statistical sales information to industry bodies);
  • companies who may use your personal data in order to tailor electronic advertising to you (e.g. on a webpage) in relation to our products and services;
  • our accountants, insurers (including those that provide extended warranties), lawyers, auditors and other professional advisers;
  • if you are an individual contractor to Ford, to your employer or agency in relation to the performance of your work with Ford;
  • if you are an individual contractor to Ford or a prospective employee, to our medical service providers for any medical assessments or in relation to any health or safety incidents and to HR related service providers (e.g. for background checks, screening or aptitude testing);

9.3 Where we disclose your personal data to third parties we will use reasonable commercial efforts to ensure that such third parties only use your personal data as reasonably required for the purpose we disclosed it to them and in a manner consistent with the Privacy Act, e.g. by including suitable privacy and confidentiality clauses in our agreement with a third party service provider to which we disclose your personal data.

9.4 If you post information to certain public parts of our website or to our social media pages, you acknowledge that such information may be available to be viewed by the public. You should use discretion in deciding what information you upload to such sites.

9.5 Ford does not share, sell, or rent personal data with independent companies for their own use without providing you a choice. If you have opted in to receive marketing materials from Ford, we may share hashed emails from our marketing database with social media advertising partners, such as Facebook, so that they can create Custom Audiences and deliver advertisements on our behalf to their members. Members are identifiable when the Social Media partner matches our hashed data to its hashed data of its members.

9.6 We may disclose your personal data as part of a corporate transaction or proceeding such as a merger, financing, acquisition, bankruptcy, dissolution, or at transfer, divestiture, or sale of all or a portion of our business or assets. Furthermore, we may disclose de-identified information (which can no longer reasonably be linked to you) to third parties for any purpose in accordance with applicable law.

10. OTHER SITES AND SERVICES

Our websites, mobile applications, and other Products may contain links to other content, products, services, features, websites, mobile applications, platforms, or properties that Ford doesn’t own or operate (“Other Sites”) even if they look similar to ours. Please be aware that Ford is not responsible for any Other Sites, their content or operation, or the privacy policies or data practices of the third parties that offer them, even if you access them via our Products, including:

  • Dealer websites;
  • Websites or services featuring events, promotions, sponsorships, contests, or sweepstakes offered by our business partners (even where co-branded with Ford or our Products);
  • Websites or services offered by companies that have received a license to use our name, logo, or other trademarks in connection with their service or product offerings (including those that offer accessories or other products available for use with Ford vehicles);
  • Advertisers on our websites;
  • Social media or networking platforms; and
  • Product review, news, or enthusiast/fan sites and other forums, message boards, or chat groups where our Products are discussed.

For example, some of our website features incorporate the Google reCAPTCHA tool, which collects hardware and software information, such as device and application data, in order to perform integrity checks and help prevent bots from using the feature. Your use of the reCAPTCHA tool is subject to the Google Privacy Policy and Terms of Use.

Ford is also not responsible for third party applications or services that are governed by a privacy policy other than Ford’s and that may

  • Be integrated with or offered through our Products;
  • Be made available to you through the vehicle infotainment system or in our mobile apps;
  • Be made available to you through the third party's app on your mobile device when you connect your mobile device to the vehicle via Bluetooth or tether; or
  • Require or permit the account you have with the third party to be linked to a Ford or Lincoln vehicle, mobile application, or other Product.

For example, some of our websites and online Products include mapping features provided by Google, HERE, and Microsoft (Bing Maps), which will collect and use personal information, including location information. If you use those mapping services, provide personal information to any of those third parties, or consent to our disclosure of personal information to them, the personal information they receive is governed by their privacy statements available via the above links. For example, if you use Bing Maps you agree to be bound by the Bing Terms of Use and Microsoft Privacy Policy.

11. Does your personal data leave the Philippines?

The parties to whom we disclose and/or transfer your personal data include parties located outside the Philippines. For example, we transfer personal data to our related companies overseas and to our overseas service providers. The countries in which these third parties are located will depend on the circumstances. Except where an exception applies under the Privacy Act, we will take reasonable steps to ensure that we are permitted to transfer personal data in accordance with the Privacy Act. We may for example, obtain contractual assurance from any recipients of personal data to ensure that your personal data will be protected by personal data protection standards which are equivalent to those required under the Privacy Act as well as to ensure that they will not violate the provisions in the Privacy Act.

12. How do we treat your personal data?

Ford takes security seriously and precaution to keep your personal data secure from any use, disclosure and any alteration without given permission. We train our employees to be aware of their roles and duty affecting personal data management. The authorized employee is entitled to learn the personal data and use it to the extent of his responsibility. Your personal data will not be distributed to any irrelevant organizations and we will not share your personal data other than related services provider companies (as specified above) only.

13. How do we treat information disclosed by your job application?

13.1 If you submit a job application to Ford, we will use the information provided by you to assess your application. Ford may disclose the information contained in your application to contracted service providers for purposes such as screening, aptitude testing, medical testing and human resources management activities.

13.2 As part of the application process or (if you are successful in being employed by Ford) after you commence employment with Ford, you may be required to complete a health questionnaire. You may also be asked to undergo a medical assessment. In that case, you will be asked to give specific consent for Ford to disclose your questionnaire to its service providers for the purposes of the medical assessment and for the relevant service providers to disclose the results of the assessment to Ford.

13.3 If you refuse to provide any of the information requested by Ford, or to consent to Ford disclosing your questionnaire to its service providers for the purpose of a medical assessment or to the disclosure of the results of your medical assessment to Ford, we may be unable to consider your application (or if you have been successful in being employed by Ford, we may not be able to consider you for particular roles or positions within Ford).

13.4 Ford may also ask you whether you agree to your personal data being provided to appropriate Ford suppliers so that you may be considered for positions with those suppliers which are relevant to your qualifications and experience.
